Terms of Service of Taktona

Version 0.1 (draft for lawyer review) · 23.10.2026

Polski · Українська · Русский · English

This is a reference translation for convenience. The legally binding text is the Polish version of the Regulamin; in case of any discrepancy the Polish version prevails (§ 4(4)). Draft: before sales open, the Service Provider's details, a lawyer's review and a readability test are still pending. The word "audit" is not used on legal pages: the service is an automated website analysis and an informational report.

§ 1. General provisions

  1. These Terms set out the rules for providing services by electronic means in the Taktona service available at taktona.com, taktona.pl, taktona.de, taktona.app and app.taktona.com (the Service), in accordance with Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
  2. The Service Provider is [IMIĘ I NAZWISKO], a sole trader (autónomo) registered in Spain, tax ID (NIF) [NIF], address: [ADRES W HISZPANII], e-mail: kontakt@taktona.com (the Service Provider).
  3. The seller of paid services to the User is Paddle.com Market Ltd (Judd House, 18-29 Mill Street, London SE1 2BA, United Kingdom), acting as merchant of record: Paddle concludes the sales contract with the User, collects the payment, issues the invoice and settles taxes. Paddle's buyer terms (paddle.com/legal/buyer-terms) also apply to purchases. The service itself is performed by the Service Provider.
  4. Definitions: User: a person using the Service; Consumer: a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code, and also a natural person referred to in Article 7aa of the Polish Consumer Rights Act; Puls: a free, automated analysis of a website performed by code; Score: a paid, full analysis of a website with a report; Monitor: a yearly watch service for one verified website (§ 2(3)); Report: the document with the results of the analysis; Panel: the part of the Service available after entering through an individual link; Verification: confirmation that the User has control of the website being analysed.

§ 2. Types and scope of services

  1. Puls (free): an automated check of the publicly accessible pages of the given website (up to 6 pages) against a fixed list of checks performed exclusively by code, without the use of artificial intelligence models. The result is a summary: the number of checks, the number of clean checks, the number of checks requiring attention, and a list of what Puls does not check. Puls never states that a website is "fully compliant".
  2. Score (paid): a full analysis of the publicly accessible pages of the website (up to 20 pages) comprising programmatic checks and content analysis by artificial intelligence models against a checklist based on Polish and EU law (including the Consumer Rights Act, the Act on Providing Services by Electronic Means, the GDPR, the Electronic Communications Law and the Act on Informing about Prices), consistency of content between pages and language versions, and basic SEO elements. Each finding contains a verbatim quotation from the website or a description of where the missing element was looked for, a severity level and a recommendation. The Report is delivered in the Panel in HTML and PDF format, in the language chosen by the User (Polish, Ukrainian or Russian). The price of Score includes one re-check of the same website within 60 days of the Report being made available, started by the User in the Panel; the new Report contains a comparison with the previous one.
  3. Monitor (paid, 12 months from activation for one verified website): daily automated checks of the HTTPS certificate, the domain expiry date and the Google Safe Browsing status; an e-mail when these signals change and an "all in time" e-mail once a month; a repeated Score analysis at no extra charge every quarter and after each update of the checklist (change in the law), started within 72 hours of the update, with the Report in the Panel. Messages are sent to the e-mail address given in the Panel; without an address the results are visible only in the Panel. Monitor does not renew automatically: we remind about the end of the period by e-mail 30 and 7 days in advance, and renewal requires a new payment or a code. The scope of the checks is described in the Service; the repeated analysis after a change in the law covers the provisions included in the checklist, whose updates we publish in the changelog.
  4. Nature of the Report. The Report is for information purposes only: it indicates signs of potential non-compliance and omissions, does not constitute legal advice, a legal opinion or tax advisory services, does not replace consultation with a legal adviser or attorney, and does not guarantee completeness or absence of errors, in particular because of the automated nature of the analysis. The Report is generated with the use of artificial intelligence, which is marked in it (Article 50 of Regulation (EU) 2024/1689). Findings of the highest severity level are reviewed by a human before the Report is released.
  5. The Service Provider analyses only publicly accessible content, respecting the robots.txt file and reasonable request limits; it does not log in to websites, does not modify them and does not access password-protected areas.

§ 3. Technical requirements and prohibition of unlawful content

  1. Using the Service requires a device with a current web browser supporting HTTPS and JavaScript, and Internet access. Downloading the Report in PDF format requires a browser or a program that reads PDF files.
  2. An account in the Service is created automatically when Puls is first run and is accessible only through an individual link displayed once. The User is responsible for keeping the link confidential; the User may voluntarily provide a contact for regaining access and may change the link in the Panel; the account is deleted on request sent by e-mail (§ 13).
  3. The User must not supply unlawful content, nor order analyses of websites the User has no control of in order to obtain information about third parties. The full Report with findings concerning legal provisions is made available only after Verification; for unverified websites the Service shows only the Puls summary, without legal findings and without quotations from them; minor technical remarks (e.g. the year in the footer) may be shown.

§ 4. Conclusion of the contract

  1. The contract for the free Puls service is concluded when the analysis is started and ends when the result is displayed; the result is available in the Panel for 72 hours.
  2. The contract for the Score or Monitor service is concluded when Paddle confirms the payment or when a valid code is activated (Code Terms); Monitor starts when it is switched on for the chosen verified website in the Panel. Before placing the order the User sees the total gross price in Polish złoty and the scope of the service; confirmation of the conclusion of the contract and the text of these Terms in a form that can be saved are available in the Panel and, if an e-mail address has been provided, are also sent to that address.
  3. Prices are given in Polish złoty and include VAT. Paddle may display the price in another currency according to its own rules; the price in PLN is binding.
  4. Contracts are concluded in Polish, Ukrainian or Russian, at the User's choice; in case of discrepancies between language versions of these Terms, the Polish version prevails.

§ 5. Verification of website ownership

  1. Before the full Report is made available, the User confirms control of the website in one of the following ways: placing a specified string of characters on the website, placing the file /.well-known/taktona-verify.txt, or a one-time code sent to an e-mail address published on that website or to an address in the website's domain. If the e-mail address confirmed by code at login is an address in the website's domain or an address published on that website, Verification takes place automatically, without an additional code.
  2. Codes are sent only to addresses the website itself publishes or to addresses in the website's domain, with content limited to the code and the information that someone has requested verification. The Service Provider does not send any other messages to addresses found on websites.
  3. The Service Provider applies limits on the number of attempts and messages to prevent abuse; the limits do not block the website owner.

§ 6. Performance of the service

  1. The Score Report is usually ready within 24 hours of the conclusion of the contract and no later than within 3 business days; the User learns of its readiness in the Panel and, if an e-mail address has been provided, also by a message without the content of the findings. If findings of the highest severity are still being checked by a human, the Report may be released without them with a clear annotation; the missing findings are added to the Report after the check, and the User is informed of this.
  2. The Report is available in the Panel for 12 months from performance of the service; after that time it is deleted.
  3. If the website cannot be crawled (e.g. robots.txt forbids access, the website does not respond), the Service Provider informs the User in the Panel, and the User may indicate another address or receive a refund.
  4. In the Panel the User may create a link to the Report that works without logging in (valid for up to 30 days, revocable) in order to pass the Report to a contractor; the User is responsible for sharing the link. In the Panel the User may also ask a question about the Report or an individual finding and mark findings as fixed; answers appear in the Panel.

§ 7. Payments

  1. Payments are handled by Paddle as the seller (merchant of record). The available payment methods (including BLIK and payment cards) are presented by Paddle in the checkout window. The invoice is issued by Paddle; a business may enter its tax ID (NIP) in the checkout window.
  2. The Service Provider has no access to the User's payment card data.

§ 8. Right of withdrawal and refunds

  1. A Consumer may withdraw from the contract for the Score or Monitor service within 14 days of its conclusion without giving any reason (Article 27 of the Consumer Rights Act). A model withdrawal form is Annex 2 to that Act; an e-mail to kontakt@taktona.com or a request through Paddle is also sufficient.
  2. When placing a Score order, the Consumer may expressly request that performance of the service begin before the withdrawal period expires; once the service has been fully performed with the Consumer's express consent, given after being informed about the loss of the right of withdrawal, the right of withdrawal no longer applies (Article 38(1)(1) of the Consumer Rights Act). This consent is collected in the Paddle checkout window.
  3. Independently of the above, the Service Provider guarantees a refund of the full price within 30 days of purchase at the User's request, without giving any reason and without any additional conditions. The refund is made to the original payment method, usually within 14 days, and is processed by Paddle. The Consumer's statutory rights are not limited by this.

§ 9. Complaints

  1. Complaints may be submitted in any form, in particular by e-mail to kontakt@taktona.com or in writing to the Service Provider's address. Details, including rights concerning digital services, are described on the Complaints and refunds page. A complaint may also be submitted through the question form in the Panel.
  2. The Service Provider responds to a Consumer's complaint within 14 days of receiving it; no response within that period means the complaint is accepted (Article 7a of the Consumer Rights Act).
  3. A Consumer may use out-of-court methods of handling complaints and pursuing claims, including mediation by the regional inspector of the Trade Inspection, permanent arbitration courts at the Trade Inspection, and the free assistance of the district (municipal) consumer ombudsman (prawakonsumenta.uokik.gov.pl). The Service Provider informs that it does not take part in out-of-court consumer dispute resolution except where required by mandatory provisions of law.

§ 10. Liability

  1. The Report is informational material (§ 2(4)). Decisions made on the basis of the Report are made by the User independently; in matters requiring legal assessment the Service Provider recommends consulting a lawyer.
  2. Towards Users who are not Consumers, the Service Provider's contractual liability is limited to the price paid for the service, excluding damage caused intentionally. Towards Consumers the Service Provider is liable under the general rules.
  3. The Service Provider is liable towards Consumers for the conformity of the digital service with the contract under Chapter 5b of the Consumer Rights Act.

§ 11. Personal data

The rules for processing personal data, including data of third parties appearing on analysed websites, are described in the Privacy Policy and the GDPR notice (Article 14).

§ 12. Intellectual property

  1. The Report is intended for the User's own use, including passing it to persons who make changes to the User's website. Reselling Reports or offering them as one's own service is prohibited.
  2. Quotations from the User's website contained in the Report remain the User's property. The name, mark and materials of the Service are protected by law.

§ 13. Account and termination

  1. The User may at any time change the link to the Panel, revoke access or request deletion of the account and data by writing to kontakt@taktona.com; data necessary for accounting is kept by Paddle under its own rules.
  2. The Service Provider may refuse to perform a service or terminate the contract for free services in case of a breach of § 3(3), giving the reason.
  3. The Panel can be accessed through the individual link or through a one-time code sent to the provided and confirmed e-mail address; no passwords are stored. The confirmed e-mail address is the account identifier and the address for notifications.

§ 14. Changes to the Terms

The Service Provider may change these Terms for important reasons (changes in law, in the scope of services or in the payment method), giving notice in the Service at least 14 days before the changes take effect. Changes do not apply to contracts concluded before they take effect.

§ 15. Governing law and disputes

  1. Contracts with Consumers habitually resident in Poland are subject to the mandatory consumer protection provisions of Polish law (Article 6 of Regulation (EC) No 593/2008). Otherwise Spanish law applies, as the law of the country where the Service Provider is established.
  2. Disputes with Consumers are resolved by the ordinary court having jurisdiction under general rules; a Consumer may also use the methods described in § 9(3).
  3. These Terms apply from [DATA WEJŚCIA W ŻYCIE]. Previous versions are available on request.
